This document (the "Agreement") establishes the terms and conditions that govern the use of the app or services offered by or through Poopify. The use of any of our services will constitute acceptance of this Agreement and will have the same legal effect as if you were providing a written signature of acceptance.
READ CAREFULLY BEFORE USING POOPIFY. THE USE OF THE SERVICE OR ANY SERVICE PROVIDED THROUGH POOPIFY IS SUBJECT TO THESE TERMS. YOU AGREE TO BE BOUND BY THE TERMS PRESENTED BELOW. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE POOPIFY IN ANY WAY OR FOR ANY PURPOSE.
These Terms establish the legal terms between you (both as an individual and as a legal entity) and Poopify Development Team ("Administration" or "we" or "Poopify").
These Terms are accepted by you when you actually use Poopify. You can print a copy of these Terms for your records, and we strongly recommend that you do so. These Terms remain in effect from the date of acceptance until termination by you or the Administration in accordance with these Terms.
You may not accept these Terms if: (a) you are not legally authorized to use the Service under the applicable laws in the country where you are located or reside; or (b) if you do not have the legal age to form a binding agreement with the Administration. By accepting these terms, you acknowledge and agree that you have reached the age to enter into such a binding agreement in the country where you are located or reside, or that you have permission from your parent or legal guardian if required by applicable law.
In some countries, there are legal and/or other restrictions on the use of Poopify and/or on downloading, installing, and/or using products, portions of products, software that are or may be available through the Service. It is your responsibility to ensure that you comply with all applicable legal restrictions in your jurisdiction.
NOTICE: You agree to follow the Children's Online Privacy Protection Act of 1998.
🆓 Free Trial
Poopify provides a free trial during which you can use all the features of the service. The free version includes limited features, while the full version requires a subscription or a one-time purchase.
🚫 Right to Refuse Service
Poopify reserves the right to refuse service to anyone, anywhere, at any time, for any reason. Such as, but not limited to: using the app for unintended purposes, recording an unreasonable number of events, using an unreasonable amount of resources, or abusing the terms, as defined solely by Poopify at our discretion.
💳 Payment and Refunds
Poopify services are provided through the Apple App Store on a paid subscription basis. Poopify's rates for services are listed in the App and on the App Store. Poopify reserves the right to change its rates at any time and/or to offer special promotions.
Poopify cannot issue refunds for services; Apple reserves this capability only for itself. Poopify does not send invoices to its customers (since we do not bill you); Apple reserves this capability only for itself. You have confidential access to your account balance information through the App Store. If you have a billing dispute, you must contact the App Store to seek a resolution.
🔄 New Features and Changes to Terms of Service
We may from time to time introduce new features to the service or modify or delete existing features. We will post any new or modified feature when it becomes available, as well as any new or modified term of this Agreement. Any new or modified term will become effective for your use of the service earlier between (i) your use of a new or modified feature to which the new or modified term refers or (ii) the date of your next App Store billing payment.
❌ Cancellation
You can stop the service at any time by contacting the App Store. You will not be entitled to any refund of unused balances if you stop the service. Additionally, you will remain responsible for payment of all costs for services rendered up to the date you stop the service.
📄 Limited License
We grant the end user a limited, non-sublicensable, non-exclusive, and revocable license to access and use Poopify, mobile applications, and Materials solely in accordance with, and subject to, these Terms and any of our other policies as indicated in Poopify.
Except as otherwise expressly permitted by these Terms, you may not: collect, use, copy, or distribute any portion of Poopify or Materials; resell, publicly perform, or publicly display any portion of the Materials; modify or otherwise make any derivative use of any portion of Poopify, mobile applications, or Materials; use any "deep-link", "page-scrape", "robot", "spider", or other automatic device, program, algorithm, or methodology that performs similar functions to access, acquire, copy, or monitor any portion of Poopify; use Poopify in a way that results in the depletion of website infrastructure resources; download (other than page caching) any portion of Poopify, Materials, or any information contained therein, or use Poopify or Materials other than for their intended purposes.

IMPORTANT: Poopify is designed exclusively for informational and personal monitoring purposes. The app is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.

- Poopify does not provide medical advice, diagnosis, or treatments
- The information provided by the app does not replace professional medical advice
- Always consult a qualified physician for matters related to your health
- Never ignore professional medical advice or delay seeking medical care because of information provided by the app
Responsible Use
- Use the app only for personal monitoring of bowel health
- Do not share sensitive health information with third parties through the app
- Maintain the security of your device to protect your health data
- Consult a doctor immediately in case of severe or persistent symptoms
📧 Notices and Complaints
The Administration may give notice of a copyright infringement claim to our users through a general notice on the Services, email to a user's email address in our records, or through written communication sent by mail.
If you believe that something on the Services violates any copyright that you own or control, you can send a notice of such violation to: support@poopifyapp.com.
🔚 Termination of Terms
Without limiting other remedies, Poopify may suspend or terminate this Agreement with you, or may terminate or suspend your use of the Services at any time if: (a) you are in breach of these Terms; (b) you are engaged in illegal actions, or violate proprietary rights, privacy rights, or intellectual property rights of any person, or any third-party rights, or otherwise create risk or possible legal exposure for us; (c) required by applicable laws/regulations and within the time limits required by such laws/regulations; (d) you are using Poopify not as originally intended; (e) you are abusing or otherwise causing extreme use of Poopify services or resources, determined at our sole discretion; (f) we decide to cease offering the Services in general.
Upon termination of these Terms: (a) all licenses and rights to use the Services will terminate immediately; (b) you will immediately cease any and all use of the Services.

NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICES ARE PROVIDED "AS IS" AND USED AT YOUR SOLE RISK WITHOUT WARRANTIES OF ANY KIND; THE ADMINISTRATION MAKES NO WARRANTIES, CLAIMS OR REPRESENTATIONS AND EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE SERVICES.
NO LIABILITY
YOU ACKNOWLEDGE AND AGREE THAT THE ADMINISTRATION WILL HAVE NO LIABILITY, IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SERVICES PROVIDED TO YOU THROUGH POOPIFY.
Specific Health Liability
- We are not responsible for medical decisions made based on app information
- We are not responsible for delays in seeking appropriate medical care
- We are not responsible for the accuracy of self-entered health information
- We are not responsible for consequences arising from improper use of the app for medical purposes

📋 Miscellaneous
These Terms constitute the relationship between you and the Administration regarding your use of the Services. If any provision of these Terms (or part thereof) is found by any court or administrative body of competent jurisdiction to be illegal, invalid, or unenforceable, then such provision (or part thereof) shall be removed from the Terms without affecting the legality, validity, or enforceability of the rest of the Terms.
We may make changes to these Terms from time to time and will post the changes at this link. The changes will be effective when posted. Please review the Terms regularly.
Applicable Law
These Terms will be governed by and construed in accordance with the laws of the State of California without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the federal courts of the United States and the state courts located in California.
Language
These Terms have been drafted in Italian. In the event of any inconsistency between a non-Italian version of these Terms and the Italian version, the Italian version will prevail.
